Brain Sort

These Terms of Service (“Terms”) form a binding agreement between you and Dinesh Rao (“we,” “us,” or “our”) and govern your access to and use of the Brain Sort mobile application and any related content and updates (collectively, the “App”). Please read them carefully.
By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be able to form a binding contract to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial entertainment. All rights not expressly granted are reserved.
You agree not to, and not to permit anyone else to:
The App, including its game designs, mechanics, graphics, animations, sounds, text, “Brain Sort” name and logo, and all related intellectual property, is owned by Dinesh Rao or its licensors and is protected by copyright, trademark, and other laws. These Terms do not transfer any ownership rights to you. You may not use our names, logos, or trademarks without our prior written permission.
The App may let you sign in using Sign in with Apple. Using this feature is optional and is also subject to Apple’s applicable terms. You are responsible for maintaining the security of your Apple ID and for any activity associated with your sign-in. We handle sign-in information as described in our Privacy Policy.
If you enable reminder notifications, you consent to the App scheduling local notifications on your device. You can disable them at any time in the App or in your device’s system settings.
The App is currently provided free of charge and does not contain in-app purchases or subscriptions. If we introduce paid features, purchases, or subscriptions in the future, additional terms and pricing will be presented to you at that time, and any purchase will be processed by the applicable app store (Apple or Google) under their terms — we do not process payments directly.
Brain Sort is provided for entertainment and leisure. While it features puzzle and “brain” games, we make no claim that the App provides any medical, psychological, educational, therapeutic, or cognitive-health benefit, and the App is not a substitute for professional advice or treatment.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DATA STORED ON YOUR DEVICE WILL NOT BE LOST. YOUR USE OF THE APP IS AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DINESH RAO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP (IF ANY) OR US $25.00. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to indemnify and hold harmless Dinesh Rao from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or of any law or the rights of a third party.
These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end the agreement at any time by deleting the App. We may suspend or discontinue the App, in whole or in part, at any time. Sections that by their nature should survive termination (including Sections 4, 8, 9, 10, 12, and 13) will survive.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and (where applicable) by the federal laws of the United States. You agree that the state and federal courts located in Alameda County, California will have exclusive jurisdiction and venue over any dispute that is not otherwise resolved, and you consent to personal jurisdiction there.
Before filing any claim, you agree to first try to resolve the dispute informally by contacting us at [email protected]; we will try in good faith to resolve it. Nothing in these Terms limits any non-waivable statutory rights or consumer-protection rights available to you under the laws of your place of residence.
The following additional terms apply if you obtained the App from the Apple App Store, and apply only to that use:
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
We may modify, update, or discontinue the App or any feature at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above and, where appropriate, provide notice in the App or on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the App.
